Objection or complaint
Do you disagree with a subsidy decision by the Fund? Then you can file a written objection.
Do you have a complaint about the Fund, the conduct of the Fund or about one of the employees? Then you can file a written complaint.
Objection
A written objection must be submitted within 6 weeks of the date of the Fund's decision. After 6 weeks, it is no longer possible to file an objection (except in exceptional cases).
You can send the objection to us by post, or email the signed letter to klachtofbezwaar@cultuurparticipatie.nl.
An objection must contain the following components:
- date
- name and address of the submitter
- signature by an authorized representative of the submitter
- description (or copy) of the decision against which the objection is directed
- the grounds (reasons) for the objection
In principle, the Fund will make a decision on the objection within 12 weeks. The 12 weeks start on the first day after the 6 weeks within which an objection must be submitted.
We submit objections for advice to an independent committee. This is the objection advisory committee. This committee assesses whether all processes have been carried out correctly and the scheme has been interpreted correctly. The committee does not provide a substantive assessment.
The objection advisory committee gives you the opportunity to explain your objection orally during a hearing. Representatives of the Fund are also invited to attend. In this way, the committee can ask both parties additional questions in an open and transparent manner.
The objection advisory committee advises the Fund's board on the decision to be taken. The Fund's board then makes a decision on the objection, taking the advice into account. If the board deviates from the advice, the reasoning is explained in the decision.
Complaint
A written complaint must be submitted within one year. Do you have a complaint about something that happened more than a year ago? Then it is no longer possible to submit it.
You can send us the complaint by post, or email the signed letter to klachtofbezwaar@cultuurparticipatie.nl. We will not process anonymous complaints.
Within 5 working days we will send you a confirmation of receipt. This will contain information about the steps we will take and when we will do this.
The Fund's board appoints a complaints officer or complaints advisory committee. The complaints officer or committee investigates the complaint and proposes appropriate measures. The complaints officer and complaints advisory committee are never directly involved in the subject of the complaint.
We always treat your complaint confidentially. Your details will only be used for the complaint investigation.
You will receive a written response with our conclusion or solution for the complaint. We aim to handle the complaint within 6 weeks of receipt. If the complaint is handled by a complaints advisory committee, this is 10 weeks. In the meantime, we will keep you informed.
Are you not satisfied with the handling of the complaint? Then you can contact the National Ombudsman.
